The Court: (To Harer) ...you're still under oath.

Defense: Officer, this ...was an antiwar protest, correct? ...And you were not ...sympathetic to...their viewpoint, correct?

Prosecutor: Objection, Your Honor.

The Court: Overruled.

Defense: ...you did not agree with their cause, correct?

...Harer: No, Sir

Is Victoria Riel Paid to Lie in Court?

Transit Police Officer Victoria Riel knows that Brian Harer went off his nut, bizarrely threatening a reporter on Boston Common who was simply doing his job.

Victoria Riel lied.

One of Riel's lies was that the reporter pestered them with flash photos. Strangely off point, and completely false, this was designed to portray Mr. Manzelli as having been aggressive and provocative. What Riel and Harer omitted from "The whole truth" is that it was Harer who picked a fight with the Reporter...by threatening to sue him for taking his picture! Manzelli (Freeman Z) was certainly targetted, not even forfor his editorial views, but simply for the fact that he reported on a protest against the Iraq invasion.

Notes on the Recording: The quality of these iuncredibly expensive "public" court recordings is horrendous. They were cleaned up at 492cafe for intelligibility, and an unintelligible sidebar conversation (at 08:00) was removed.

Interesting Fact:

Harer said at trial (though it's 'missing' from his affidavit) that when the Reporter tossed a cassette (understood to possibly be a recording of MBTA police misconduct) away from the Police, that it struck a woman on the head ...and that she fell to her knees! Listen to Riel's testimony. Apparently Harer embellished this without telling Riel, because she 'forgot' all about the alleged woman allegedly hit on the head allegedly falling to her knees. You see... "It all happened very quickly!"

The Prosecution's story paints Manzelli as having hidden a microphone in his jacket and bothering Harer and Riel with paparazzo-like aggressive photography. Prosecution implied Manzelli wanted to provoke the Transit Police Officers into saying something "incriminating." Sound a little far-fetched?

Manzelli, who publishes under the pseudonym "FreemanZ" is a nationally published photographer and the co-founder of a parenting magazine. He also produces several hours of radio material per month. He was on assignment, recording for a Boston area radio station, microphone in hand, when he met Harer and Riel.
